By accessing or using the Tutor Swan platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

These terms constitute a legally binding agreement between you and Tutor Swan Private Limited, a company registered in Maharashtra, India.

Tutor Swan provides an AI-powered assessment platform for educational institutions that includes:

• AI-based grading of handwritten answer booklets
• Paper pattern creation and management
• Student performance analytics
• Role-based access for administrators, teachers, and students

To use our Service, you must:

• Be at least 18 years old (for admin and teacher accounts)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

• Subscription fees are based on the number of students registered
• All prices are in Indian Rupees (INR) and inclusive of applicable taxes
• Payments are processed securely through PhonePe
• Subscription is activated immediately upon successful payment
• Refunds are subject to our Refund Policy

You agree NOT to:

• Use the Service for any illegal purpose
• Upload malicious content or viruses
• Attempt to gain unauthorized access to our systems
• Share your account credentials with unauthorized users
• Scrape or collect data from our platform without permission
• Use the AI grading system for purposes other than educational assessment

The Tutor Swan platform, including its design, features, and content, is protected by intellectual property laws. You retain ownership of any content you upload (such as question papers and model answers), but grant us a license to use this content to provide the Service.

Our AI grading system is designed to assist teachers, not replace them. While we strive for accuracy:

• AI grades are suggestions and should be reviewed by teachers
• We do not guarantee 100% accuracy in handwriting recognition
• Final grading decisions remain with the teacher
• We are not liable for any grading errors or their consequences

To the maximum extent permitted by law, Tutor Swan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the Service.

We reserve the right to terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
